MiniaturZ, operated by Jesús Izquierdo ("we", "us", or "our"), offers its interactive 3D platform for online therapeutic sessions and related services to you under the condition that you accept these Terms and Conditions and all related policies.
These Terms and Conditions constitute a legally binding agreement between you ("you" or "User") and Jesús Izquierdo regarding your use of the MiniaturZ website, platform, and services (collectively, the "Service").
By creating an account or using MiniaturZ, you confirm that you have read, understood, and agree to be bound by these terms, including our Privacy Policy.
PLEASE READ THE FOLLOWING TERMS CAREFULLY BEFORE USING THE SERVICE.
1. Service Overview
MiniaturZ is an interactive 3D platform designed for conducting online therapeutic sessions using projective techniques. The Service includes, but is not limited to:
- Interactive 3D environments with manipulable miniatures for various therapeutic techniques
- Real-time video and audio communication
- Proprietary collaborative therapy session tools
- Secure, frictionless patient access via unique session links (no patient registration required)
- Subscription plan management and billing
2. Eligibility
To use the Service as a therapist, you must:
- Be at least 18 years of age
- Hold valid, current professional credentials (license, registration, or equivalent) in your jurisdiction to practice psychology, counseling, coaching, or a related therapeutic profession
- Comply with all applicable local, national, and international laws and regulations governing your professional practice
- Maintain appropriate professional liability insurance as required in your jurisdiction
Patients access sessions exclusively through secure links provided by their therapist. Patients do not create accounts on MiniaturZ. For patients under 18 years of age (or the applicable age of majority), the therapist must obtain and document verifiable parental or guardian consent before the session.
3. Account Registration
To access the Service as a therapist, you must:
- Create an account using accurate and complete information
- Keep your account credentials secure and not share them with third parties
- Notify us immediately at [email protected] of any unauthorized access to your account
- Accept that you are solely responsible for all activity that occurs under your account
4. Subscription Plans and Trial
MiniaturZ offers the following subscription structure:
- Lite Plan (Free): Limited access to the platform with a reduced miniature catalogue. Available indefinitely at no cost
- Essential and Pro Plans: Paid subscription plans with full access to features as described on our pricing page. Billed monthly or annually
- Free Trial: New users receive a 14-day trial or 3 sessions (whichever limit is reached first) with full Pro access. No payment information is required to start the trial
- At the end of the trial period, your account reverts to the Lite (free) plan unless you subscribe to a paid plan. No automatic charges occur
5. Payment Terms
- Subscription fees are billed in advance (monthly or annually) through Stripe under Stripe's terms of service. MiniaturZ does not store, process, or have access to your credit card number or payment method details
- Prices are displayed in EUR, USD, or GBP depending on your selected currency and include applicable taxes where required by law
- We may adjust subscription fees with at least 30 days' prior written notice (via email). The new fees will apply at the start of your next billing cycle after the notice period. If you disagree with the new pricing, you may cancel your subscription before the new fees take effect
- You are responsible for any applicable taxes not included in the displayed price, as determined by your jurisdiction

6. Right of Withdrawal (EU Users)
Under EU Directive 2011/83/EU and applicable national consumer protection laws, you have the right to withdraw from a paid subscription within 14 calendar days of purchase without giving any reason.
- To exercise this right, notify us by email at [email protected] within 14 days of your purchase date with a clear statement of your decision to withdraw
- If you have not used any paid features during the withdrawal period, we will issue a full refund to your original payment method within 14 days of receiving your withdrawal notice
- If you have actively used paid features during the withdrawal period, you expressly consent to the commencement of the service and acknowledge that you may forfeit part or all of the right to a full refund, proportional to the service already provided, in accordance with Art. 14(3) of Directive 2011/83/EU
- After the 14-day withdrawal period, paid subscriptions are non-refundable for the current billing period. You may cancel at any time, and your access will continue until the end of the current paid period
7. Professional Conduct
Therapists using the Service must:
- Maintain all applicable professional standards, codes of ethics, and deontological obligations at all times
- Ensure patient confidentiality in accordance with applicable laws and professional regulations
- Obtain informed consent from patients (or their legal guardians) before conducting sessions via MiniaturZ, including disclosure that a third-party digital platform is being used
- Maintain appropriate clinical documentation as required by their regulatory body
- Not use the Service as a substitute for in-person assessment or intervention when professional standards require it
8. Data Processing Responsibilities
The therapist is the data controller for all patient data processed through MiniaturZ. MiniaturZ acts as a data processor on the therapist's behalf, as defined in GDPR Art. 28.
- The therapist is responsible for establishing and documenting the legal basis for processing patient data (e.g., patient consent, legitimate interest, or legal obligation)
- The therapist must inform patients that the session is conducted through a third-party platform and provide relevant privacy information
- MiniaturZ processes patient data (such as first names displayed during sessions and video/audio streams) only for the purpose of providing the Service and in accordance with the therapist's instructions
- Patient names displayed during sessions are never stored permanently. Video and audio streams are transmitted peer-to-peer and never pass through or are recorded by MiniaturZ servers
- A Data Processing Agreement (DPA) under GDPR Art. 28 is available upon request at [email protected]
9. Clinical and Regulatory Disclaimer
MiniaturZ is a technology tool that facilitates therapeutic sessions. It is important to understand the following:
- MiniaturZ does not provide clinical advice, diagnosis, or treatment recommendations. All clinical decisions remain the sole responsibility of the licensed therapist
- MiniaturZ is not a healthcare provider, medical device, or regulated health entity. It is not subject to HIPAA (United States), and no Business Associate Agreement (BAA) is offered
- Therapists are solely responsible for determining whether the use of a digital platform is appropriate for each patient and each therapeutic context
- MiniaturZ does not access, store, or process clinical records, health data, or protected health information (PHI)
- The therapeutic relationship exists exclusively between the therapist and the patient. MiniaturZ is not a party to that relationship
10. Intellectual Property
The Service, including all software, source code, algorithms, visual design, 3D models, textures, user interface, proprietary therapeutic tools, workflows, and content, is the exclusive property of Jesús Izquierdo or its licensors and is protected by applicable intellectual property laws, including copyright, trade secret, and, where applicable, patent law. The architecture, design, and implementation of the Service constitute confidential trade secrets of Jesús Izquierdo. Users retain ownership of any original content they create during sessions (such as spatial arrangements). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license solely to the extent necessary to provide, maintain, and improve the Service.
11. Privacy and Confidentiality
We maintain strict privacy and data protection standards as detailed in our Privacy Policy.
12. Prohibited Activities
You agree not to:
- Share, transfer, or allow others to use your account credentials
- Record, capture, or screenshot therapy sessions without the explicit consent of all participants
- Use the Service for any purpose other than legitimate therapeutic, educational, or professional activities
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, data structures, or underlying technology of the Service
- Use the Service, or any knowledge, information, or insights gained through its use, to build, assist in building, or contribute to a competing product or service, whether directly or through a third party
- Systematically scrape, extract, or collect data, features, workflows, or design elements from the Service for any purpose, including competitive analysis or replication
- Use the Service to harass, harm, threaten, or discriminate against any person
- Upload malicious software or interfere with the operation of the Service
- Use the Service in violation of any applicable law, regulation, or professional code of ethics
- Resell, sublicense, or commercially redistribute access to the Service
- Remove, alter, or obscure any proprietary notices, labels, or markings on the Service
13. Disclaimer of Warranties
To the extent permitted by applicable law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or completely secure operation of the Service. This disclaimer does not affect your statutory rights as a consumer under applicable EU or national law, including the conformity guarantees under EU Directive 2019/770 (Digital Content Directive). Where mandatory consumer protections apply, they shall prevail over this clause.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Jesús Izquierdo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claim related to the Service shall not exceed the total fees you have paid to us in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability for willful misconduct, gross negligence, or death or personal injury caused by our negligence.
15. Indemnification
You agree to indemnify, defend, and hold harmless Jesús Izquierdo, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your breach of applicable laws, professional regulations, or ethical obligations; (c) any claim by a patient or third party arising from your therapeutic practice conducted through the Service; or (d) your negligence or willful misconduct. This indemnification obligation shall survive termination of your account.
16. Term and Termination
These Terms remain in effect as long as you maintain an account with MiniaturZ.
- You may terminate your account at any time by contacting us at [email protected] or through your account settings. Your access will continue until the end of the current paid billing period, after which your data will be deleted in accordance with our Privacy Policy
- We may suspend or restrict your access to the Service immediately if you violate these Terms, engage in prohibited activities, or if required by law. We will notify you of the reasons for suspension unless prevented by law
- We may terminate your account with 30 days' written notice for any other legitimate business reason, including discontinuation of the Service. In such case, you will receive a pro-rata refund for any unused prepaid subscription period
- Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall remain in effect
17. Changes to Terms
We may update these Terms to reflect changes in the Service, legal requirements, or business practices. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with any material change, you may terminate your account before the effective date and receive a pro-rata refund for any unused prepaid subscription period.
18. Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond the party's reasonable control, including but not limited to: natural disasters, acts of government, pandemics, internet or telecommunications failures, cyberattacks, or failure of third-party service providers. The affected party shall notify the other party promptly and make reasonable efforts to mitigate the impact.
19. 3D Model Attributions
MiniaturZ uses 3D models obtained under various open-source and creative commons licenses. We gratefully acknowledge all original creators and their contributions.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain. This choice of jurisdiction does not deprive consumers in the EU of the protection afforded by the mandatory provisions of the law of their country of habitual residence, in accordance with Regulation (EC) No 593/2008 (Rome I).
21. General Provisions
- Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable
- Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Jesús Izquierdo regarding the Service and supersede all prior agreements and understandings
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us
- Language: These Terms are available in English and Spanish. In the event of any discrepancy between the two versions, the Spanish version shall prevail for users in Spain and the English version for all other users
